Maximum Prices in the Procurement Procedure for Goods and Services
By Administrative Decision No. 472/2020 published in the Official Gazette on 7 April 7, 2020, the Chief of Ministers established that in purchase processes to provide supplies needed for the health emergency carried out within the framework of the Procurement Procedure for Goods and Services governed by Administrative Decision No. 409/2020, the Government shall not pay higher amounts than the maximum consumer prices established by the Resolution No. 100/2020 of the Secretary of Domestic Trade or those maximum prices established in the future.
This decision will be applied to all purchase processes currently in progress that as of this date have not been awarded. Likewise, in cases where the purchase processes have not concluded, each Minister and its decentralized bodies shall carry out the necessary steps to guarantee that maximum prices are complied with in all cases. In cases where the purchase process has already been formally awarded with outstanding payment obligations, the corresponding amount will be paid exclusively up to the maximum price currently in force. For these purposes, the National Procurement Office is empowered to issue the clarifying and complementary regulations that it may deem appropriate.
