INCORPORATION OF EXEMPTED ACTIVITIES AND SERVICES

Administrative Decision No. 429/2020

The following activities and services were included in the list of exceptions to the obligation of social and mandatory quarantine:

1. Industries that carry out continuous processes, which interruption implies structural damage to production lines and/or machinery. In this case, they may request authorization from the Secretariat of Industry, Knowledge-Based Economy and External Commercial Management, so as not to discontinue their production, but minimizing their activity and staffing.

2. Production and distribution of biofuels.

3. Operation of nuclear power plants.

4. Hotels used for the health emergency service.

5. Minimum staffing necessary for the operation of the Argentine Aircraft Factory Brig. San Martín S.A.

6. The authorities of the Argentine Securities Commission.

7. Airport operation. Garage and parking operations.

8. Sustaining activities related to environmental mining protection.

9. Tanneries.

10. Restaurants, food shops and fast food shops, may sell their products through home delivery services, subject to the specific protocol established by the health authority.

It is also clarified that, in the case of the food industry -an activity also included in the exceptions- all those activities that are part of the chain value and supplies of the food and beverage production sectors, personal hygiene and cleaning are included, as well as medical equipment, medicines, vaccines and other sanitary supplies.

Our opinion

In all these cases, in order to prevent the spread of the virus, the activities and services included in this regulation must be provided with the minimum number of personnel and subject to the protocol established by the health authority.

CIRCULATION AUTHORIZATIONS – SAFE-CONDUCTS

Employers must provide personnel who must continue to provide essential tasks with a certificate stating the name, telephone number and other information that allows proper identification of the company; name, national identity document number and address of the worker, his/her qualification as essential personnel and address of the workplace.

·          Decree 163/2020 – Government of the City of Buenos Aires

People who must justify their circulation within the area of the City of Buenos Aires must submit an affidavit that is completed online (https://www.buenosaires.gob.ar/coronavirus), which must include their personal data and that they are included within the exceptions to the mandatory quarantine.

Private sector employers must furnish the personnel who must continue to provide essential tasks with a certificate stating the name, telephone number and other information that allows proper identification of the company; name, national identity document number and address of the worker, his/her qualification as essential personnel and address of the workplace.

·          Administrative Decision 427/2020 – EMPLOYEES OF THE NATIONAL PUBLIC SECTOR

The heads of each jurisdiction, entity or body of the National Public Sector will establish the list of the public agents that render essential services for the operation of the corresponding body and must grant a certificate proving the exception to circulate.

·          Resolution 132/2020 - EXCEPTIONS RELATED TO THE ASSISTANCE OF CHILDREN AND ADOLESCENTS

Circulation of children and teen agers is authorized only in three cases:

1. When at the time the social, preventive and mandatory quarantine came into effect, the child or teen ager were in a different residence from that of his or her center of life. The transfer is authorized only once.

2. When the parent, for working reasons, is included among the personnel that provide essential activities and services, or for reasons of assistance to third parties or other causes of force majeure, the parent must be absent from the residence in which the minor is located. In this case, the child or teen ager may be moved to the residence of the other parent, family member or person of emotional reference.

3. For health reasons and always in the best interest of the child, he/she must be moved to the other parent's home.

·          Resolution 133/2020 – EXCEPTION RELATED TO THE ASSISTANCE OF OLDER PERSONS

In the case of relatives or professional caregivers of the elderly, they must present an affidavit to circulate, which includes the personal data of the relative or caregiver, as well as the data, address and hours of care of the person assisted.

CARGO TRANSPORTATION

The Ministry of Transport informed that the transport of national and international cargo, in all its forms: air, land, sea, river, lake; is authorized to circulate.
